Mediation FAQs

What is mediation?

Mediation is a voluntary, confidential process where a neutral third party helps disputing parties reach a mutually acceptable resolution. Unlike litigation, mediation encourages open dialogue and collaboration, allowing parties to have more control over the outcome.

What is the mediator’s role?

As a mediator, my role is to act as a neutral facilitator. I do not make decisions or offer legal advice. Instead, I guide discussions, try to clarify issues, and help both parties explore options to reach a mutually acceptable agreement.

Is mediation legally binding?

Mediation itself is not legally binding unless both parties agree to the terms and sign a written settlement agreement. Once signed, the agreement will be enforceable in court.

Can a mediator give legal advice to the parties?

No, a mediator cannot give legal advice to the parties. The mediator’s role is to remain neutral, facilitate discussions, and help parties explore possible solutions without advocating for either side.
